GENERAL TERMS AND CONDITIONS

Under these General Terms and Conditions, we define the relationship between our company, NATUR APATYKA s.r.o., IN 28540395, Klimentská 2061/21, 110 00 Prague 1, Czech Republic, as the seller and operator of the e-shop at www.naturapatyka.cz, and you, our customer, who enters into a purchase agreement with us.

1. User responsibilities

The user agrees to use the online store in accordance with the regulations and generally applicable laws.
The user undertakes to provide truthful information about themselves on the online store's registration form and to change any incorrect information without delay.
The user accepts the order and delivery terms and conditions regarding the order.
The user accepts the changes made by NATUR APATYKA s.r.o. related to their customership.
The user is responsible for the sanctions resulting from the unauthorized use of material protected by the copyrights of NATUR APATYKA s.r.o. and its partners.

2. The service provider's responsibilities

The service provider is responsible for all content presented in the online store.
The service provider is responsible for ensuring that all content presented in the online store (images, etc.) complies with the law.
The service provider has the right to change, update and correct the content and/or rules of the online store without separate notification to the users.
The service provider is not responsible for incorrect information about the online store presented by external services or companies.
The service provider is responsible for all customer data it collects and for their proper storage.
If necessary, the service provider can cancel the order. Abuses are always reported to the authorities.

3. Information about products

All image and text materials presented in the online store are the property of the service provider and/or its partners. Unauthorized use or copying of image and text material protected by copyright is prohibited.

Product prices include VAT. We reserve the right to change prices and delivery costs. The product is sold at the price indicated on the online store page at the time of ordering. NATUR APATYKA s.r.o. reserves the right not to sell the product at a price that, due to technical or human reasons, has been updated in the online store incorrectly. In such a case, general contract law principles apply. NATUR APATYKA s.r.o. is in contact with the customer before processing the order, and canceling the transaction is possible.

The information presented in the online store is informative in nature and should not be considered as an invitation to an individual purchase contract.

Information about the costs related to packaging and delivery of the goods is published in the online store.

4. Ordering

In the case of a purchase agreement concluded via www.naturapatyka.cz, the order placed by the order’s submission on the website shall constitute a draft purchase agreement. The order shall be valid for the period of 7 days and we will confirm its receipt by e-mail. All orders are confirmed by email, which states the price of the order, shipping costs and the ordered products. This confirmation is automatic. If the customer does not receive an order confirmation, the order was probably not successful, or there was an error in the e-mail address provided. In this case we encourage you to contact us.

A binding contract is created when the customer has placed an order and received an order confirmation by e-mail or when he has accepted the order at the checkout. The purchase agreement shall then be concluded upon our acceptance of the draft in the form of shipping the ordered goods. We will inform you of the shipment of goods by e-mail.

However, the contract cannot be considered to have been formed if the customer has chosen advance payment as the payment method and the payment transaction fails.

5. Methods of Payment and Delivery

You can select the method of payment and delivery from the options we offer. Prior to the shipment of the order, we will notify you of the selected method of payment and delivery and the associated costs. In the case of choosing the online card payment option, the customer takes into account that the payment will be withdrawn from the card right at the moment of transaction.

6. Delivery policy

We collect and ship products every weekday. Postage costs are the same regardless of package size. Packages are shipped in 1-2 working days. Delivery costs include postage and packaging costs.

The delivery fee is indicated on the order page of the online store.

The customer is responsible for the correctness of the delivery address they have given. The delivery address must be specified exactly according to the name, street address, town and postal code.

If the customer provides an incorrect delivery address and the carrier returns the shipment to the sender due to the customer's, NATUR APATYKA s.r.o. charges the customer with postage and freight costs and handling fees.

The delivery time indicated on the website is an estimate. NATUR APATYKA s.r.o. is not responsible for delivery delays beyond the company's control, such as weather conditions preventing the delivery of goods, natural disaster, war, accident, import or export ban, decision of the authorities, disruption or obstruction of traffic or energy distribution, industrial action or other similar circumstances preventing the operation of NATUR APATYKA s.r.o.

7. Offer codes and discounts

NATUR APATYKA's marketing channels sometimes publish offer codes for our online store. A percentage discount is given for normally priced products.
In special discount campaigns, we may limit the use of the discount code to one time per customer. This means that the code can only be used by registered/logged-in customers and only once.

8. Withdrawal

By law, you are entitled to withdraw from an agreement concluded on the Internet without giving a reason within 14 days of delivery of the goods.

If you wish to exercise this right, you must notify us of your decision to withdraw from the agreement within the aforesaid time limit. The best way to do this is to contact us at info@naturapatyka.cz. Merely returning the goods is not enough for cancellation, the customer must indicate his wish to cancel the contract. If the consumer wants to return the product based on the right of cancellation, the consumer must submit a cancellation notification within 14 days. The deadline does not include the day when the products have been received. The consumer can therefore make a cancellation notification after two weeks on the same day of the week when he has received the order. After submitting the cancellation notice, the consumer still has 14 days to return the product. The product is considered returned if it has been handed over to the carrier.

It is the customer's responsibility to prove with a receipt, if necessary, that the return has been made within the deadline. The return can be made on the next business day if the last return day falls on a holiday or weekend.

In the event of withdrawal from the agreement, we will refund the purchase price of the goods.

The customer pays the costs of the return.

Once the return is approved, the money will be refunded directly to your account within 14 days after the return is received and processed. If the payment method is a credit card, the refund will be credited to your credit card bill.

If the product has been lost during transport, it has been damaged or the wrong product has been delivered to the customer, the customer must report the error immediately to the e-mail address info@naturapatyka.cz.

9. Complaint Procedure

If the goods show a defect upon delivery, we can agree on compensation in the form of a voucher. You shall also be entitled to require the removal of the defect in the form of a replacement delivery or repair.

The customer shall send the goods that are the subject of the complaint to the seller’s location at the following address: NATUR APATYKA s.r.o., Klimentská 2061/21, 110 00 Prague 1, Czech Republic.

Unless the seller and the customer agree otherwise, the complaint, including any defects, will be processed without any undue delay within no more than thirty (30) calendar days of the date the complaint is lodged.

10. Alternative dispute resolution

If disagreements cannot be resolved by negotiation between the parties, the customer can refer the matter to Česká obchodní inspekce (Czech Trade Inspection Authority), 567/15 Štěpánská, 120 00 Prague 2, IN: 000 20 869, Internet address: https://adr.coi.cz/cs, whose responsibility is the out-of-court settlement of consumer disputes related to the purchase contract. The dispute resolution platform located on the website http://ec.europa.eu/consumers/odr can be also used to resolve disputes between the seller and the customer related to the purchase contract.

11. Final Provisions

All arrangements between the seller and the customer are governed by the law of the Czech Republic. If the relationship established by the purchase contract contains an international element, then the parties agree that the relationship is governed by the law of the Czech Republic. This does not affect consumer rights arising from generally binding legal regulations.

In relation to the customer, the seller is not bound by any codes of conduct in the sense of the provisions of § 1826 paragraph 1 letter e) of the Civil Code.

All rights to the seller's website, in particular copyright to the content, including page layout, photos, films, graphics, trademarks, logos and other content and elements, belong to the seller. It is forbidden to copy, modify or otherwise use the website or part of it without the consent of the seller.

The seller is not responsible for errors arising as a result of interventions by third parties in the online store or as a result of its use contrary to its purpose. When using the online store, the customer must not use procedures that could have a negative effect on its operation and must not perform any activity that could allow him or third parties to interfere or use the software or other components that make up the online store in such a way that would be contrary to its purpose or purpose.

The customer hereby assumes the risk of a change in circumstances within the meaning of § 1765, paragraph 2 of the Civil Code.

The purchase contract is archived by the seller in electronic form and is not accessible.

The wording of the terms and conditions may be changed or supplemented by the seller. This provision does not affect the rights and obligations arising during the period of validity of the previous version of the terms and conditions.

In case of contradiction between the Czech version of these T&C and any of its translations, the Czech version shall prevail.

These terms and conditions take effect on 30/11/2023.
